Terms

Last updated: [TBD: date]

These terms govern the purchase and use of QBIT software downloaded from this site. By buying, downloading or installing a QBIT product you agree to them. If you do not agree, do not install the software.

1. Parties

The seller and licensor is [TBD: legal entity name and address], referred to as “QBIT”, “we” or “us”. The buyer and licensee is the person or company that completes the purchase, referred to as “you”.

2. What you buy

You buy a licence to use the software, not the software itself. QBIT keeps all ownership, copyright and other intellectual property rights in the software, its code, its documentation and its name. Nothing in these terms transfers those rights to you.

3. Licence scope

The licence is personal, non-exclusive and non-transferable. It lets you install and use the software on [TBD: number of machines] that you own or control, for your own trading. You may not:

  • sell, rent, lend, sublicense, share or otherwise redistribute the software or your licence;
  • copy the software except for a backup;
  • reverse engineer, decompile, disassemble or otherwise try to derive its source code, except where the law expressly allows it;
  • remove or alter any licence check, notice or mark;
  • use the software to build a competing product.

4. Platform

QBIT products are add-ons. They run only inside a trading platform that you license yourself, and they are not a platform. QBIT is an independent developer and is not affiliated with, sponsored by or endorsed by the owners of ATAS, DeepCharts or MetaTrader. You are responsible for holding a valid licence for the platform, for complying with its terms, and for any broker or prop-firm rules that apply to your accounts. QBIT does not ask for and does not store your platform credentials.

5. V-Bridge

V-Bridge is distributed free of charge under the GNU General Public License v3.0, and that licence, not sections 2 and 3 above, governs your rights to copy, modify and redistribute it. V-Bridge comes with no warranty. You are responsible for how you trade with it and for your prop firm’s rules on copiers and external software.

6. Delivery

The software is delivered as a Windows installer that you download. Delivery is complete when the download link and your licence details have been sent to the email address you gave at checkout. [TBD: how and when the download link is delivered]

7. Payment

[TBD: prices, billing model, checkout provider]. Prices are shown at checkout before you pay. Payment is processed by the checkout provider under its own terms; QBIT does not see or store your card details. Taxes are added where the law requires.

8. Refunds

[TBD: refund policy]

9. Updates and support

[TBD: which updates are included, for how long, and what support covers]. Support is provided by email at [TBD: support email]. QBIT may release updates that change or remove features, and may stop supporting platform versions that the platform vendor no longer supports.

10. No warranty of trading results

QBIT products are analysis software. They show market data; they do not give investment advice, do not generate trading signals and do not guarantee any result. Trading futures and leveraged products involves substantial risk of loss. Every trading decision you make, and every order placed through your accounts, is yours alone. The software is provided “as is” and “as available”. To the extent the law allows, QBIT disclaims all other warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. Market data shown by the software comes from your platform and broker; QBIT is not responsible for its accuracy or availability.

11. Limitation of liability

To the extent the law allows, QBIT is not liable for any trading losses, lost profits, lost data, missed orders, prop-firm rule breaches, or indirect, incidental or consequential damages arising from the software or your use of it, even if advised of the possibility. QBIT’s total liability for any claim connected to a product is limited to the amount you paid for that product in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Termination

QBIT may end your licence if you breach these terms, in particular section 3. When the licence ends you must stop using the software and remove it from your machines. Sections 2, 10, 11 and 13 survive termination.

13. Governing law

These terms are governed by the laws of [TBD: jurisdiction], and its courts have jurisdiction over any dispute, without prejudice to any consumer rights that apply where you live.

14. Changes

QBIT may update these terms. The date at the top shows the current version. Changes apply to purchases made after they are published; they do not change the terms of a purchase you have already made.
